Participation in the Contest is subject to the terms and conditions set out below (these “Terms and Conditions”). By submitting an Entry (as defined in Clause 5 below), you agree to be bound by and to participate in the Contest in accordance with these Terms and Conditions.

  1. The Contest is organized by BandLab Singapore Pte. Ltd. (“Organiser”) and is made available via the music creation platform named ‘BandLab’ (“Service”).  The Contest is based on skill and expertise.
  1. The Contest is open to all individual users of the Service:

(a) resident in all territories except employees of the Organiser, sponsoring companies and their agencies, and their immediate family members; and

(b) who are at least 18 years old or the applicable age of majority in their jurisdiction of residence, (each, the “Participant”).

  1. The Participant must have access to the Internet, and no purchase or payment is necessary to participate in the Contest. It is the Participant’s responsibility to ensure that his/her participation in the Contest is legal and compliant with the laws and regulations of the Participant’s state, country and jurisdiction of residence. Organiser reserves the right to hold void, suspend, cancel, or amend the Contest where prohibited by law and where it deems necessary to do so.
  1. Participation in the Contest is subject to these Terms and Conditions, the BandLab Terms of Use, and such other rules, regulations and procedures prescribed by the Organiser in relation to the Contest. In the event of any inconsistency between these Terms and Conditions and the BandLab Terms of Use, these Terms and Conditions shall prevail. Any failure to comply will result in the Participant being disqualified from the Contest, and the Contest winner being disqualified and any prize(s) won shall be forfeited.
  1. The Participant may enter the contest by submitting a comment in the BandLab Feed Post answering the question 1. Comment how 310babii has inspired you to freestyle or influenced your music. 2. Pick your favorite 310babii track, tell us why, and drop your own track in the comments inspired by his music. (each, an “Entry”). The Participant may submit multiple Entries. 
  1. The Organiser cannot accept: (a) responsibility for Entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; nor (b) proof of transmission as evidence of receipt of an Entry to the Contest. Organiser will also not accept Entries that are: 

(i) automatically generated by computer or created by artificial intelligence;

(ii) completed by third parties in bulk;

(iii) illegible, have been altered, reconstructed, forged or tampered with;

(iv) incomplete; or

(v) deemed to be defamatory, obscene, unlawful, abusive, libelous, pornographic, or inappropriate, as determined in Organiser’s sole discretion.

  1. The Contest starts on 8, October, 2025, 7pm,  PST and ends on 28, October, 2025, 7pm PST. No Entries will be accepted after the Contest closes for whatever reason.
  1. By submitting an Entry, the Participant represents, warrants and undertakes as follows: 
  1. all his/her personal information provided in the Entry is true, correct and complete, and that he/she is not assuming a false identity; 
  2. all works used in their Entry are (i) the original works of the Participant and free of any encumbrances, (ii) works that are in the public domain, and/or (iii) will not violate, conflict with, or infringe upon any rights whatsoever of any entity or individual;
  3. no assignment has been or will be made of any rights to the Entry which will prevent Organiser or any third party from using the Entry as set out in these Terms and Conditions;
  4. the Participant has full right and power to enter into these Terms and Conditions and to assign and grant all rights granted hereunder, without restriction of any third-party  person or agreement; 
  5. the Participant will execute any documents and forms necessary to grant and assign the rights to the entry to Organiser as set out in these Terms and Conditions; and
  6. the Participant will not do anything in connection with the Entry that may be deemed unlawful, abusive, libelous, defamatory, pornographic or obscene, or will promote or incite harassment, violence, terrorism, illegal acts, or hatred on the grounds of race, ethnicity, cultural identity, religious belief, disability, gender, identity or sexual orientation or that may bring the Organiser or their affiliates into disrepute.
  1. The Organiser reserves the right to reject any Entry it deems inappropriate in its sole discretion at any time without prior notice.
  1. The Organiser’s designated judges will curate the Entries and select 1 winner based on their Entry’s overall merits taking into consideration the following judging criteria: originality (30%), creativity and innovation in response (30%), and clarity and quality of expression (40%) of each Entry. 
  1. All decisions made by the Organiser in relation to the Contest are final and no enquiries, appeals, verbal or written or any other correspondence will be entertained. The Participant agrees to accept and abide by all decisions made by the Organiser.
  1. The Contest prizes are $500 USD and 2 T-shirts. 
  1. The prize(s) are awarded “as is”. To the fullest extent permissible under law, the Organiser disclaims all warranties, representations or guarantees, express or implied, in fact or in law, in respect of any aspect of the prize(s) including without limitations, quality, merchantability and fitness for a particular purpose; and the winner(s) shall not look to the Organiser for such warranties or claims, if any.
  1. The winners of the Contest will be notified via an announcement on the Service feed, in which they will be tagged. Prizes will be sent out within [4 to 8 weeks] of notification.
  1. The Participant must indemnify, defend and hold harmless the Organiser and its affiliates, and their respective officers, directors, shareholders, employees, agents, representatives, partners, contractors, service providers, agents, successors, licensees and assigns (collectively, “Indemnified Entities”) from and against from and against all damages, losses, costs and expenses (including reasonable attorney’s fees and costs) arising out of or in connection with: (a) the Participant’s breach of these Terms and Conditions; or (b) a claim that Participant’s Entry infringes any third-party rights.

The Participant expressly acknowledges and agrees that Indemnified Parties shall not be liable to the Participant for any claim, liability, damages, cost, loss or expense whatsoever or howsoever caused arising directly or indirectly in connection with his/her participation in the Contest.

  1. In the event of a claim for copyright infringement against Indemnified Entities arising from, related to and/or in connection with the winning Entry, the Organiser reserves the right, in addition to any other available remedies, to forfeit the prize or to deduct any damages/losses payable from the prize, at its sole discretion.
  1. The submission of an Entry by the Participant is consent provided to the Organiser under the Singapore Personal Data Protection Act 2012 for the collection, use and disclosure of the Participant’s personal data by/to the Organiser, the sponsoring companies, and other third parties promoting and/or organising the Contest, for the purpose of administering the Contest, and research and analysis. The Participant agrees to be bound by the terms of the BandLab Privacy Policy.
  1. The winner(s) agree to the use of their winning Entry, name/handle and/or image (as may be applicable) in announcing the Contest winners, and advertising, promotion and other publicity purposes connected to the Contest without payment or compensation.
  1. The Participant shall not grant any interviews or discuss with any member of the press or other media his/her participation in the Contest, without first notifying and obtaining the prior written consent of the Organiser.
  1. The Participant shall not be entitled to injunctive relief (including, without limitation, a temporary or preliminary injunction) in any action arising out of or relating to the Contest. This waiver of injunctive relief shall apply to all claims, whether arising in contract, tort or otherwise.
  1. The Organiser reserves the right to change, amend or add to these Terms and Conditions without prior notice. The Organiser further reserves the right, without any liability on its part whatsoever, to cancel, postpone, terminate, suspend or in any other way cease the Contest at any time without prior notice.
  1. Unless prohibited by applicable law, these Terms and Conditions shall be governed by and construed in accordance with the laws of Singapore. The Participants agree to submit to the exclusive jurisdiction of the courts of Singapore. No provisions of these Terms and Conditions are intended to affect statutory rights afforded to consumers in their country of residence. These Terms and Conditions and each provision contained herein will be interpreted in such a manner as to be effective and valid under applicable law, but if any provision of these Terms and Conditions shall be prohibited by or invalid under applicable law, such provision shall be ineffective only to the extent of such prohibition or invalidity and shall not invalidate the remainder of such provision or the remaining provisions of this certificate which will remain in full force and effect. To the extent any provision of these Terms and Conditions has such an effect, it should be considered as not applicable to Participants resident in that country.
